1. Agreement to these Terms

By creating or using a SPUDZWARE account, creating or managing a server, purchasing or using a plan, redeeming rewards, linking an external service, or starting a server after being shown the first-start notice, you agree to these Terms and acknowledge the Privacy Policy.

2. Accounts and access

You are responsible for activity performed through your account and for protecting the Google account or other linked services used to access SPUDZWARE. Do not share access in a way that enables unauthorized control of another person's server or account.

Server owners may grant limited permissions to other users. Shared users must follow these Terms and may only use the permissions granted to them.

3. Acceptable use

You may use SPUDZWARE for legitimate Minecraft hosting and related management. You may not intentionally damage the service, overload infrastructure, evade plan/resource limits, interfere with other users, exploit security weaknesses, access data you are not authorized to access, distribute malware through the service, or use SPUDZWARE to facilitate unlawful activity.

Power-action abuse is specifically prohibited. Repeated or clearly automated Start/Restart requests can trigger SPUDZWARE's anti-abuse protections and may result in permanent account restrictions.

4. Paid plans and billing

Starter, Performance, and Ultimate are paid account plans. Each successful payment grants exactly 30 days of paid-plan access. A successful renewal grants another 30 days. SPUDZWARE may notify you approximately 7 days before the current paid period expires.

If the required renewal payment is not successfully received by the expiration time, SPUDZWARE provides a 2-day grace period. If payment is still not received by the end of that grace period, the paid entitlement may be canceled and affected servers may return to Free resources according to the current service rules.

Active paid-plan servers are protected from the normal Free-server inactivity deletion rule while the paid entitlement or billing grace period remains active.

5. Free servers and inactivity

Free servers may be permanently deleted after 30 days without qualifying use. SPUDZWARE is designed to send a warning approximately 7 days before an inactivity deletion. Users are responsible for keeping copies of important worlds and data.

6. Reward Servers

Reward Servers are temporary servers with the resource profile shown at redemption. Under the current rewards schedule, 20 SPUDZWARE Reward Points provides a 7-day Reward Server and 60 points provides a 30-day Reward Server. Reward Server time begins when the temporary server is created.

Reward Server time expires at the end of the redeemed period and the server may then be permanently deleted. Ultimate is subscription-only and cannot be obtained through SPUDZWARE Rewards.

7. Server upgrades and account plans

Paid hosting entitlement belongs to the account. Eligible servers owned by the account can use server resource profiles allowed by that account plan. SPUDZWARE may adjust server resources when an account plan expires, is canceled, changes, or is otherwise no longer eligible.

8. Backups and Google Drive

SPUDZWARE may provide local and optional Google Drive backup tools. Backups are provided as a convenience and are not a guarantee against data loss. You should keep independent copies of worlds or files that are important to you.

When you link Google Drive, use of Google data is governed by the SPUDZWARE Privacy Policy and the permissions you grant through Google.

9. Service availability and changes

SPUDZWARE is an evolving hosting service and may change features, resource limits, supported Minecraft versions/loaders, prices, routing, maintenance procedures, or availability. Maintenance, network failures, software bugs, game updates, third-party services, hardware limits, and events outside SPUDZWARE's control can cause interruptions.

10. Suspension and termination

SPUDZWARE may restrict, suspend, or terminate access when reasonably necessary to protect the platform, other users, infrastructure, billing integrity, or security; to respond to repeated abuse; or to address violations of these Terms. Serious automated server-start abuse may result in a permanent ban.

11. Your server content

You remain responsible for the worlds, files, mods, plugins, configuration, and other content you place on your server, including ensuring you have the right to use that content. SPUDZWARE needs permission to process and copy that content only as necessary to host, operate, back up, restore, move, or delete the server as requested or required by these Terms.

12. Disclaimer and limitation

To the extent permitted by applicable law, SPUDZWARE is provided on an "as available" basis. SPUDZWARE does not promise uninterrupted operation or that every third-party mod, plugin, game version, network, or backup will work without error. Nothing in these Terms excludes rights or protections that cannot legally be excluded.

13. Changes to these Terms

SPUDZWARE may update these Terms as the service changes. When a new Terms version requires renewed acceptance, SPUDZWARE may present the updated notice before a future server Start/Restart action.
